ACC Paid Extended Leave of 6 months

A client had a employee who took extended leave where he was paid directly by ACC. He was "off the payroll".

He had the same contract on his return but this doesn't mention this situation.

Is it safe to assume annual leave did not accrue?

 
Answer

Confirmed with the Department of Labour on 0800 20 90 20.

The anniversary date for the employee remains the same and the employer is responsible for holiday pay - however in terms of calculating the average daily pay, where the employee hasn't received any, the average daily rate will be very low or nil.
